These Terms of Service ("Terms") govern your access to and use of FeelMeters™, including feelmeters.com and related websites, applications, features, communications, and services (collectively, the "Service"). FeelMeters is operated by FeelSynch LLC ("FeelSynch," "FeelMeters," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What FeelMeters Is

FeelMeters is a communication and decision-making service designed to help people ask questions and receive structured responses quickly. Depending on the feature, a sender may select a question and available response choices, send a FeelMeter to one or more recipients, set a response deadline, and view responses or results. The Service may include Individual FeelMeters, Group FeelMeters, timers or deadlines, voting and result features, question categories, communication links, account/history features, and other communication tools. Features may be added, changed, tested, or removed as the Service develops.

2. FeelMeters Is a Communication Tool

A FeelMeter response is not necessarily a complete explanation of another person's thoughts, feelings, intentions, consent, agreement, or circumstances. Responses may serve as a decision, preference, indication, check-in, or starting point for further conversation. You are responsible for deciding how to interpret and act upon information received through a FeelMeter.

3. Minimum Age

You must be at least 13 years old to use FeelMeters. FeelMeters is a general-audience service and is not directed to children under 13. If you are under the age of majority where you live, you may use FeelMeters only with the permission and supervision of a parent or legal guardian where required by applicable law. If we learn that we collected personal information from a child under 13 in a manner prohibited by applicable law, we may delete the information and terminate or restrict the associated account or access.

4. Accounts

Some features may require an account, while other features may allow recipients to respond without creating an account. If you create an account, you agree to provide accurate information, maintain the security of your login credentials, and accept responsibility for activity occurring through your account. Notify us promptly if you believe your account has been accessed without authorization.

5. Acceptable Use

You may use FeelMeters only for lawful and appropriate communication. You may not use the Service to threaten, harass, stalk, bully, intimidate, impersonate, defraud, deceive, distribute unlawful or sexually exploitative material, solicit personal information from children under 13, facilitate illegal activity, send spam or unsolicited commercial messages, interfere with the Service, attempt unauthorized access, or violate another person's rights or applicable law.

6. Responses Are Voluntary

Recipients are not required to respond to a FeelMeter. A failure to respond does not constitute legal consent, agreement, approval, rejection, or acceptance of any proposition. FeelMeters must not be used as a substitute for legally required consent, authorization, notice, signature, or acknowledgment.

7. Sensitive and Important Decisions

FeelMeters does not provide medical, mental-health, legal, financial, tax, safety, emergency, or other professional advice. Do not rely solely on a FeelMeter when professional advice, formal consent, emergency assistance, or legally binding authorization is required. FeelMeters must not be used to determine whether another person has provided legal consent to sexual activity or any other activity for which affirmative consent is legally required.

8. Group FeelMeters

Group FeelMeters may allow multiple participants to respond to a question. Results may depend on the number of responses, response deadlines, participant eligibility, tie-breaking rules, and settings selected by the sender or provided by FeelMeters. If a Group FeelMeter uses an automatic tie-break, FeelMeters may randomly select among tied choices according to the rules displayed for that Meter.

9. Timers and Deadlines

Some FeelMeters may include response deadlines. Responses received after a deadline may not be included in the final result. We do not guarantee that notifications, messages, internet connections, devices, or third-party communication systems will operate without interruption. Senders should allow reasonable time for recipients to receive and respond to time-sensitive FeelMeters.

10. Intellectual Property

FeelMeters™, FeelSynch™, associated names, logos, meter designs, branding, graphics, software, website designs, question libraries, curated answer choices, text, and other original content are owned by or licensed to FeelSynch LLC and are protected by applicable intellectual-property laws. These Terms give you permission to use the Service for its intended purpose; they do not transfer ownership of our intellectual property. You may not reproduce, sell, copy, scrape, systematically extract, distribute, reverse engineer, or commercially exploit substantial portions of the Service or proprietary content except as permitted by law or with our written permission.

11. Feedback and Suggestions

If you voluntarily provide suggestions, ideas, feature requests, or other feedback about FeelMeters, you grant FeelSynch LLC permission to use that feedback to develop, improve, market, and operate our products and services without compensation or obligation to you. This does not give us ownership of your unrelated intellectual property.

12. Third-Party Services

FeelMeters may rely on or link to third-party services such as hosting providers, email or messaging providers, analytics providers, advertising platforms, authentication providers, payment processors, and other technology providers. We are not responsible for third-party services we do not control. Your use of those services may also be governed by their own terms and privacy policies.

13. MVP, Beta, and Experimental Features

FeelMeters may release features as MVP, beta, preview, experimental, or early-access features. These features may contain bugs, change without notice, operate differently than expected, experience interruptions, or be discontinued. Feedback during these stages helps us improve the Service.

14. Availability

We want FeelMeters to be reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, maintain, restrict, or discontinue all or part of the Service when reasonably necessary.

15. Disclaimer of Warranties

To the extent permitted by law, FeelMeters is provided "as is" and "as available." We do not guarantee that every recipient will respond, that responses will be truthful or accurate, that a FeelMeter will resolve a disagreement, that users will interpret responses in the same manner, that the Service will always be available, or that use of FeelMeters will produce a particular personal, relationship, social, or business outcome. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, FeelSynch LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of FeelMeters. Nothing in these Terms limits liability where applicable law prohibits such limitation.

17. Suspension and Termination

You may stop using FeelMeters at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, engaged in unlawful conduct, or misused the Service. Where appropriate, we may provide notice before taking action.

18. Privacy and Cookies

Our collection and use of personal information is described in the FeelMeters Privacy Policy. Our use of cookies and similar technologies is described in the FeelMeters Cookie Policy.

19. Changes to These Terms

We may update these Terms as the Service, applicable laws, or our business practices change. When appropriate, we will provide notice of material changes. The Last Updated date identifies the most recent revision. Continued use of the Service after updated Terms become effective constitutes acceptance where permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
